SCOTUSblog. The D.C. Circuit threw out one of the cases that arose out of the military commissions related to Guantanamo: Hamdan. What he did wasn’t defined as a crime when he did it. Criminal law students, note the legality principle at work. Fed Courts students, note the retroactivity and separation of powers principles. Also, there’s a potential mootness issue. Hamdan served his sentence and was sent home.
